Terms of Service

1. Acceptance of Terms

Menubear is operated by LIONBYTE SOFTWARE S.R.L., a company incorporated in Romania, with its registered office at Str. Razelor nr. 6, Sector 1, 012643 București, Romania, registered with the Trade Register under no. J40/4856/2020, fiscal code (CUI) 42482428 ("Menubear", "we"). See the Legal Notice for full identification details.

By accessing or using Menubear ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Menubear provides digital menu management, table ordering, reservation management, and related tools for restaurants ("Customers"). Guests access menus via QR codes without creating an account.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

4. Subscription & Billing

New accounts start with a 14-day free trial of the PRO plan; no payment details are required for the trial. When the trial ends, the account automatically moves to the free MENU plan unless you subscribe to a paid plan.

Paid plans are billed monthly via Stripe. You may cancel at any time; access continues until the end of the billing period. Refunds are not provided for partial months. Prices may change with at least 30 days' notice; changes apply from your next billing period.

5. Acceptable Use

You may not use the Service for illegal purposes, to transmit harmful code, or to interfere with other users. We reserve the right to suspend accounts that violate these terms.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of your restaurant data.

6a. Data Processing Agreement (GDPR Art. 28)

When you process personal data of your restaurant guests through Menubear (e.g. orders, reservations), you act as the data controller and Menubear acts as your data processor. Our Data Processing Agreement forms part of these Terms and is incorporated by reference. By using the Service you accept the DPA as written.

7. Limitation of Liability

Menubear is provided "as is." To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service, and our total aggregate liability under these Terms is capped at the fees you paid to Menubear in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for intent (dol) or gross negligence (culpă gravă), or any other liability that cannot be excluded under applicable law.

8. Changes to Terms

We may update these Terms. Material changes are announced by email at least 14 days before they take effect; continued use of the Service after that date constitutes acceptance. Non-material changes are reflected on this page with an updated "Last updated" date.

9. Governing Law & Jurisdiction

These Terms are governed by Romanian law. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably is subject to the jurisdiction of the competent courts of București, Romania. Mandatory protections you enjoy under the law of your country of residence remain unaffected.
